Can an estate agent refund a lettings fee in the form of a credit note instead of cash?

We rented out our property through an estate agent, the tenancy contract has been renewed for 2008 and the agent charged us the full years letting fee plus renewal fee in advance. Now our tenants have given notice and are moving out two months earlier than the contract. We asked our agent to refund the two months lettings fee he has charged us as the tenants are moving out. He refuses and will only give us the two months as a credit note for us to use his service again in the future. His agency is not registered ARLA of Association of Estate Agents, what can I do to resolve this? I want to get my money back, as we do not plan to use his service again.

Unless your contract with the estate agent says otherwise you are entitled to a refund of the agency fee. If the agent still refuses to refund it, you should threaten to sue him in the County Court, when you shall also claim interest and costs.
