Our tenant's boyfriend has moved into the property. How do we go about adding him to the Tenancy Agreement?
We have a property let to a female who is the only person on the tenancy Agreement. Her boyfriend has moved in - no real problem with that - but how do we go about adding him to the Tenancy Agreement? Do we have to issue a new Tenancy Agreement and, if so, does the deposit now have to go into the government deposit scheme? Or can we simply amend the existing pre 2007 Agreement?
You could leave it as it is - any possession order against the lady would apply to her partner as well, although he will have no liability for rent. If you want to obtain rent from him as well you could grant a new tenancy but this will mean that they are entitled to a minimum of a further six months tenancy. If you do not take a new deposit the TDS will not apply, as it is determined by the date the deposit is received, not the date the tenancy starts.
