Please can you advise how much notice is to be given to a tenant renting a property? I have heard that it is one month plus 42 days as I have young children, is this correct? I have been living in the property for six months and my terms are now up for renewal. I have been told that they will not be renewing my tenancy.

You will need to be served with a Section 21 Notice, which must afford you at least two months notice and must end on the last day of the tenancy term then existing when the Notice expires. After the Notice has been served possession can still not be obtained from you until proceedings have been issued and a Court Order made. Even if the claim is undefended it takes approximately six weeks or more to obtain a possession Order from the date of issue. Note however that if proceedings are required it is likely that a costs Order will be made against you. Once the possession Order has been made you are likely to be given fourteen days to vacate, although this can be extended to up to six weeks in exceptional circumstances. When this period has expired the landlord still is unable to obtain possession until he has instructed the bailiff to attend, which could take another two weeks or more. If you are in danger of being made homeless you must keep the Local Authority's housing department informed as you must not do anything that could result in their considering you voluntarily homeless and consequently not re-homeable by them.
